Representation Agreement:

REPRESENTATION AND CONTINGENT FEE AGREEMENT:

Scope of Representation

Cureton Clark P.C. (referred to herein as “We”) has offered to provide the legal representation described below to builders who are owners and/or creditors of the Home Owner’s Warranty Insurance Company in connection with any claim (“Claim”) those builders may have to any funds that may be due to builders from the fund (“Fund”) arising from the liquidation of HOWIC, its parent, the Home Owner’s Warranty Company, and any of its subsidiaries (collectively referred to herein as HOW) in accordance with an Order issued by the Insurance Commissioner of Virginia approving a Plan of Liquidation docketed on June 23, 2005 at Case Number INS-1994-218. You may be entitled to make a Claim and receive a distribution (“Distribution”). Whether you are entitled to make a Claim or receive a Distribution is defined in the application for liquidation filed by the Receiver of to the Virginia State Corporation Commission and incorporated into that Order.

We have engaged the law firm of Spotts Fain of Richmond Virginia, to serve as local counsel. We may retain and associate with other persons to provide this representation to you and other owner/builders in this matter.
